1. Acceptance of Terms

By accessing or using Peritale (the "Service"), operated by MARKABLE Ltd. ("we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Peritale is a smartphone-based hormonal wellness tool that brings together four wellness signals, AI-powered facial analysis, cognitive assessment tasks, sensory checks for hearing and vision, and symptom tracking, to generate a personal wellness profile.

3. Eligibility

You must be at least 18 years of age to use Peritale. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activity under your account
• You agree to provide accurate information when creating an account
• You must notify us immediately of any unauthorized use of your account

5. Wellness Disclaimer

The wellness information provided by Peritale is for general informational and personal awareness purposes only. It is not a substitute for professional medical advice, examination, or treatment.

• Peritale results are wellness indicators, not clinical assessments
• Results may vary and are influenced by environmental factors (lighting, image quality)
• We use language such as "associated with" and "may" because wellness patterns are correlational, not causative
• You should share your results with a qualified healthcare provider before making any health-related decisions
• Do not delay seeking medical advice based on Peritale results

6. Facial Image Processing

By using the selfie analysis feature, you consent to:

• The real-time processing of your facial image by our AI system
• The extraction and storage of numerical wellness data derived from your image
• The storage of your facial image in encrypted form for the purpose of generating your wellness profile and enabling longitudinal tracking
• The use of anonymized, aggregated data for product improvement

Facial images are stored securely using encryption at rest and in transit. You may request deletion of your images at any time. See our Privacy Policy for full details.

7. Pricing and Payment

• Free check: Your first wellness check is free with basic results. No credit card required.
• Starter Month: $9.99 USD one-time payment. Includes your full wellness report, provider PDF, and 30 days of access to all Peri Tools. No subscription or auto-renewal.
• Monthly plan: $9.99 USD per month. Includes ongoing monthly wellness checks, full reports, and access to all Peri Tools. Renews automatically until cancelled.
• Annual plan: $5.99 USD per month ($71.88 billed annually). Same benefits as Monthly at a 40% discount. Renews automatically until cancelled.
• Automatic renewal: The Monthly and Annual plans are recurring subscriptions. By subscribing, you authorize us to charge your payment method the recurring amount and interval shown at checkout ($9.99 USD per month for Monthly, or $71.88 USD per year for Annual) on each renewal date, until you cancel. We will obtain your express consent to these renewal terms before charging you.
• Cancel anytime: You may cancel any subscription at any time through your account settings or by emailing hello@peritale.online. Cancellation stops future renewals and takes effect at the end of the current billing period. You keep access until that period ends.
• Prices may change with notice. Active subscriptions will be honored at the price in effect at the time of purchase until the end of the current billing cycle.
• All payments are processed securely through our payment provider.

8. Refund Policy

All paid plans include a 30-day money-back guarantee. If you are unsatisfied with the Service within 30 days of purchase, contact us at hello@peritale.online for a full refund. After the 30-day period, refund requests are handled on a case-by-case basis.

9. Intellectual Property

All content, technology, algorithms, designs, and branding associated with Peritale are the intellectual property of MARKABLE Ltd. and are protected by applicable copyright, trademark, and patent laws.

• You may not copy, modify, or reverse-engineer any part of the Service
• You may not use our trademarks without written permission
• Your wellness data and results belong to you

10. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Submit false information or images of other people without their consent
• Attempt to gain unauthorized access to our systems
• Scrape, crawl, or otherwise extract data from the Service beyond your own results
• Use the Service to develop competing products
• Misrepresent Peritale results as medical diagnoses

11. Limitation of Liability

To the maximum extent permitted by law:

• Peritale is provided "as is" and "as available" without warranties of any kind
• We do not warrant that results will be accurate, complete, or reliable for any particular purpose
• We are not liable for any health decisions made based on Peritale results
• Our total liability to you shall not exceed the amount you paid for the Service in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages

12. Indemnification

You agree to indemnify and hold harmless MARKABLE Ltd. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases, and we will delete your data upon request.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via the website. Continued use of the Service after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Tel Aviv-Jaffa, Israel.
