Terms of Service

1. Acceptance of terms

By accessing or using Peritale (the "Service"), operated by MARKABLE Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What Peritale is

Peritale is a general wellness self-awareness and self-tracking companion for women in midlife. It combines facial biomarkers read from a selfie photo, cognition, hearing, vision, and comprehensive symptom mapping to reflect a general wellness picture you can follow over time.

3. Eligibility

You must be at least 18 years of age to use Peritale. By using the Service, you confirm that you are at least 18 and have the legal capacity to enter into these Terms.

4. Your account

• You can sign in with Google, Facebook, Apple or email. Sign-in is handled by our provider Supabase.
• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity under your account.
• You agree to provide accurate information when you create an account.
• You must tell us promptly of any unauthorised use of your account.

5. Wellness disclaimer

The wellness information Peritale provides is for general self-awareness only. It is not a substitute for professional advice, examination or care.

• Peritale results are wellness reflections, not clinical assessments.
• Results may vary and can be affected by factors such as lighting and image quality.
• We use careful language such as "associated with" and "may", because wellness patterns are correlational, not causative.
• Please share your results with a qualified healthcare professional before making any health-related decision.
• Do not delay seeking professional advice because of anything Peritale shows you.

6. Your selfie, photos and voice

The mapping uses a selfie photo taken in the app and, if you use daily check-ins, your spoken answers and meal photos. Before the camera opens, the app asks you to tick a consent box. By giving your consent you agree to:

• the analysis of your selfie, including measuring features of your face and skin by image-analysis providers that work for us, to build your mapping and your report;
• the storage of your images and results in our cloud systems, and the processing of check-in audio and meal photos by Google (Gemini). Your images stay stored until you ask us to delete them, as set out in the Privacy Policy.

Research use is a separate, optional box in the app. Saying no changes nothing about your mapping or your report.

You can withdraw your consent and ask us to delete your images and data at any time by writing to privacy@peritale.online. We never sell your face or voice data. See our Privacy Policy for the full detail and your rights under the Personal Data (Privacy) Ordinance (PDPO).

On our website, analytics cookies load only after you accept them in the cookie banner. In the app, session-recording and usage-analytics tools load only after you accept them. We do not use advertising cookies or retargeting pixels. See our Cookie Policy.

7. Pricing and subscription

• First mapping free: your first mapping is free, and no payment card is required.
• Subscription: to continue with monthly mappings, full reports and the daily wellness tools, you can take out a small monthly subscription. It renews automatically each month until you cancel.
• Cancel anytime: you may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Prices may change with notice. Any change will apply from your next billing period, not the current one.
• All payments are processed through our payment provider, PayPal.

8. Refund policy

Every paid plan comes with a full refund if you ask within 14 days of your purchase. Email us at hello@peritale.online within that period and we will refund you in full. After 14 days, refund requests are considered on a case-by-case basis. Nothing in these Terms affects any non-excludable rights you may have under Hong Kong consumer protection law, including the Sale of Goods Ordinance (Cap. 26) and the Trade Descriptions Ordinance (Cap. 362).

9. Intellectual property

All content, technology, models, designs and branding associated with Peritale are the intellectual property of MARKABLE Ltd. and are protected by applicable copyright, trademark and patent laws. Patent pending. MARKABLE™ and Peritale™ are trademarks of MARKABLE™ Ltd.

• You may not copy, modify or reverse-engineer any part of the Service.
• You may not use our trademarks without written permission.
• Your wellness data and results are yours. You can ask us for a copy by writing to privacy@peritale.online.

10. Acceptable use

You agree not to:

• use the Service for any unlawful purpose;
• submit images of other people without their consent;
• attempt to gain unauthorised access to our systems;
• scrape or extract data from the Service beyond your own results;
• use the Service to build a competing product; or
• present Peritale results as a medical diagnosis.

11. Limitation of liability

To the maximum extent permitted by law:

• Peritale is provided "as is" and "as available", without warranties of any kind;
• we do not warrant that results will be accurate, complete or reliable for any particular purpose;
• we are not liable for any health decision made on the basis of Peritale results;
• our total aggregate liability to you will not exceed the greater of the amount you paid for the Service in the 12 months before the claim, or HKD 600; and
• we are not liable for indirect, incidental, special or consequential loss.

Nothing in these Terms limits any liability that cannot be limited under Hong Kong law.

12. Indemnification

You agree to indemnify and hold harmless MARKABLE Ltd. and its officers, directors, employees and agents from any claim, damage or expense arising from your use of the Service or your breach of these Terms.

13. Termination

We may suspend or end your access to the Service for a breach of these Terms. You may close your account at any time by contacting us. On termination, your right to use the Service ends, and you can ask us to delete your data by writing to privacy@peritale.online. We answer deletion requests within 30 days; what is deleted, and what is not yet removed automatically, is set out in our Privacy Policy. This does not apply where retention is required by law.

14. Changes to these terms

We may update these Terms from time to time. We will post material changes on the website. Continuing to use the Service after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Israel. This does not deprive you, as a consumer in Hong Kong, of the protection of mandatory Hong Kong consumer law, and you keep the right to bring a claim in your local courts where Hong Kong law gives you that right.
