1. Acceptance of Terms

By accessing or using Peritale (the "Service"), operated by MARKABLE Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Peritale is a general wellness self-awareness and self-tracking companion for women in midlife. It combines an AI-based facial wellness read, brief THINK and SENSE self-check exercises, and symptom self-reporting to generate a personal wellness picture you can track over time.

3. Eligibility

You must be at least 18 years of age to use Peritale. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Your Account

• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity under your account.
• You agree to provide accurate information when creating an account.
• You must notify us promptly of any unauthorised use of your account.

5. Wellness Disclaimer

The information Peritale provides is for general wellness, self-awareness and educational purposes only. It is not a substitute for professional medical advice, examination, diagnosis or treatment.

• Peritale results are wellness reflections, not clinical assessments.
• Results may vary and can be influenced by factors such as lighting and image quality.
• We use language such as "associated with" and "may", because wellness patterns are correlational and not causative.
• You should share your results with a qualified registered medical practitioner before making any health-related decision.
• Do not delay seeking medical advice because of anything Peritale shows you.

6. Facial Image Processing

By using the selfie wellness read, you consent to:

• The processing of your facial image to extract numerical wellness data points.
• The storage of your facial image in encrypted form, only if you consent, so that your wellness picture can be generated and tracked over time.
• The use of de-identified, aggregated data for product improvement.

Your facial geometry is treated as sensitive personal data and is processed only on the basis of your explicit consent. You may withdraw consent and request deletion of your images at any time. See our Privacy Policy for full details.

7. Pricing and Payment

• Free first read: Your first wellness read is free, with no credit or debit card required.
• Subscription: After your free read, full access is offered as a small monthly subscription. It includes your full wellness picture, your doctor-visit summary and access to the daily wellness tools.
• Auto-renewal: The subscription renews automatically each billing period until you cancel. We will tell you the price clearly before you subscribe.
• Cancel anytime: You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you will not be charged again after that.
• Prices may change with prior notice. Any active subscription will be honoured at the price in effect at the time of purchase until the end of the current billing cycle.
• All prices are inclusive of applicable taxes unless stated otherwise. Payments are processed securely through our payment provider.

8. Cancellation and Refunds

You can cancel your subscription at any time from your account settings or by contacting us at hello@peritale.online. On cancellation, your access continues until the end of the billing period you have already paid for, and auto-renewal stops.

All paid plans include a 30-day money-back guarantee. If you are not satisfied within 30 days of your purchase, contact us at hello@peritale.online for a full refund. Approved refunds are processed back to your original payment method within a reasonable period, typically 5 to 7 business days, subject to your bank or payment provider's timelines. After the 30-day period, refund requests are considered on a case-by-case basis. These terms are in addition to, and do not limit, any rights you have under the Consumer Protection Act 2019 and other applicable Indian law.

9. Intellectual Property

All content, technology, algorithms, designs and branding associated with Peritale are the intellectual property of MARKABLE Ltd. and are protected by applicable copyright, trademark and patent laws. Patent pending.

• You may not copy, modify or reverse-engineer any part of the Service.
• You may not use our trademarks without written permission.
• Your wellness data and results belong to you.

10. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose.
• Submit false information, or images of other people without their consent.
• Attempt to gain unauthorised access to our systems.
• Scrape, crawl or otherwise extract data from the Service beyond your own results.
• Use the Service to develop a competing product.
• Present Peritale results as a medical diagnosis.

11. Limitation of Liability

To the maximum extent permitted by law:

• Peritale is provided "as is" and "as available" without warranties of any kind.
• We do not warrant that results will be accurate, complete or reliable for any particular purpose.
• We are not liable for any health decisions you make based on Peritale results.
• Our total aggregate liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim, or ₹6,000, whichever is greater.
• We are not liable for indirect, incidental, special or consequential damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded under applicable Indian law, including your statutory rights as a consumer.

12. Indemnification

You agree to indemnify and hold harmless MARKABLE Ltd. and its officers, directors, employees and agents from any claims, damages or expenses arising from your use of the Service or your breach of these Terms.

13. Termination

We may suspend or terminate your access to the Service if you breach these Terms. You may close your account at any time by contacting us. On termination, your right to use the Service ends, and we will delete your data on request, except where retention is required by law.

14. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. This does not affect your rights as a consumer in India: you retain the right to bring claims and complaints before the competent consumer forums in India under the Consumer Protection Act 2019.
