1. Acceptance of terms

By accessing or using Peritale (the "Service"), operated by MARKABLE Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of the Service

Peritale is a perimenopause wellness companion that combines a selfie-based facial wellness read, brief cognitive (THINK) and sensory (SENSE) exercises, and symptom tracking to give you a personal wellness picture, a summary to bring to your healthcare provider, and a set of small daily wellness tools. Peritale is a general wellness product. It does not measure your hormones, run a blood test, or replace your doctor.

3. Eligibility

You must be at least 18 years of age to use Peritale. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Your account

• You are responsible for keeping your account credentials confidential.
• You are responsible for all activity under your account.
• You agree to provide accurate information when creating an account.
• You must tell us promptly of any unauthorised use of your account.

5. Wellness disclaimer

The wellness information Peritale provides is for general information and personal awareness only. It is not a substitute for professional medical advice, examination, or treatment.

• Peritale results are wellness indicators, not clinical assessments.
• Results may vary and can be affected by factors such as lighting and image quality.
• We use language such as "associated with" and "may", because wellness patterns are correlational, not causative.
• Please share your results with a qualified healthcare provider before making any health decision.
• Do not delay seeking medical advice because of a Peritale result.

6. Facial image processing

By using the selfie read, you consent to:

• the processing of your facial image to extract numerical wellness data points;
• the storage of your facial image in encrypted form, where you have consented, to generate your wellness picture and track it over time;
• the use of anonymised, aggregated data for product improvement.

Your facial data is never sold, and you may withdraw consent and request deletion of your images at any time. See our Privacy Policy for full details and your rights under the Personal Data Protection Act 2012 (PDPA).

7. Pricing and payment

• First read free: your first wellness read is free, with no credit card required.
• Subscription: continued access is a small monthly subscription that renews automatically until you cancel.
• Cancel anytime: you may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Prices may change with notice. Active subscriptions are honoured at the price in effect at purchase until the end of the current billing cycle.
• All payments are processed securely through our payment provider. Prices are shown at checkout and may be charged in Singapore dollars or another currency depending on your payment method.

8. Cancellation and refunds

All paid plans include a 30-day money-back guarantee. If you are not satisfied within 30 days of your purchase, email hello@peritale.online and we will refund that payment in full. After 30 days, you can still cancel at any time to stop future renewals, and refund requests are then handled on a case-by-case basis. Nothing in these Terms limits any non-excludable rights you may have as a consumer under the Consumer Protection (Fair Trading) Act and the Lemon Law provisions of the Sale of Goods Act in Singapore.

9. Intellectual property

All content, technology, algorithms, designs, and branding associated with Peritale are the intellectual property of MARKABLE Ltd. and are protected by applicable copyright, trademark, and patent laws. Patent pending. MARKABLE™ and Peritale™ are trademarks of MARKABLE™ Ltd.

• You may not copy, modify, or reverse-engineer any part of the Service.
• You may not use our trademarks without written permission.
• Your wellness data and results belong to you.

10. Prohibited uses

You agree not to:

• use the Service for any unlawful purpose;
• submit false information or images of other people without their consent;
• attempt to gain unauthorised access to our systems;
• scrape, crawl, or extract data from the Service beyond your own results;
• use the Service to develop competing products; or
• misrepresent Peritale results as medical diagnoses.

11. Limitation of liability

To the maximum extent permitted by law:

• the Service is provided "as is" and "as available" without warranties of any kind;
• we do not warrant that results will be accurate, complete, or reliable for any particular purpose;
• we are not liable for any health decision made on the basis of a Peritale result;
• our total liability to you will not exceed the amount you paid for the Service in the 12 months before the claim, or SGD 100, whichever is greater; and
• we are not liable for indirect, incidental, special, or consequential damages.

Nothing in this section excludes liability that cannot be excluded under Singapore law.

12. Indemnification

You agree to indemnify and hold harmless MARKABLE Ltd. and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or your breach of these Terms.

13. Termination

We may suspend or end your access to the Service for breach of these Terms. You may close your account at any time by contacting us. On termination, your right to use the Service ends, and we will delete your personal data on request, except where retention is required by law.

14. Changes to these terms

We may update these Terms from time to time. We will notify users of material changes via the website. Continued use of the Service after changes take effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Israel, without regard to conflict of law principles. This does not deprive you of the protection of mandatory consumer laws in Singapore, and you retain the right to bring a claim in your local courts under the Consumer Protection (Fair Trading) Act where that applies.
