1. Acceptance of terms

By accessing or using Peritale (the "Service"), operated by MARKABLE Ltd. ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. What Peritale is

Peritale is a perimenopause wellness companion. It brings together a selfie-based facial wellness read, brief cognitive (THINK) and sensory (SENSE) exercises, and symptom tracking to give you a personal wellness picture and a summary you can take to your GP.

3. Eligibility

You must be at least 18 years old to use Peritale. By using the Service, you confirm that you are at least 18 and have the legal capacity to enter into these terms.

4. Your account

• You are responsible for keeping your account credentials confidential.
• You are responsible for activity that takes place under your account.
• You agree to give accurate information when you create an account.
• You must tell us promptly about any unauthorised use of your account.

5. Wellness disclaimer

The wellness information Peritale provides is for general information and personal awareness only. It is not a substitute for professional medical advice, examination, or treatment.

• Peritale results are wellness indicators, not clinical assessments.
• Results may vary and can be affected by factors such as lighting and image quality.
• We use language such as "associated with" and "may", because wellness patterns are correlational, not causal.
• You should discuss your results with a qualified healthcare professional before making any health-related decision.
• Do not delay seeking medical advice because of a Peritale result. In an emergency, call 999.

6. Your facial wellness read

By using the selfie read, you consent to the analysis of your facial image into biometric facial geometry, and to the encrypted storage of your image and the data derived from it, only where you have given that consent, so we can generate your wellness picture and track it over time. You can withdraw your consent and request deletion at any time. We never sell your facial data. Please see our Privacy Policy for full details.

7. Pricing and subscriptions

• First read free: your first wellness read is free, with no card required.
• Subscription: after that, full access is a small monthly subscription. Prices are shown on our pricing page before you pay.
• Auto-renewal: your subscription renews automatically at the end of each billing period until you cancel it.
• Cancel anytime: you can cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
• Price changes: we may change prices with notice. Any change takes effect from your next billing period.
• All payments are processed securely through our payment provider.

8. Your 14-day cooling-off right

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel a paid subscription within 14 days of entering into the contract, without giving a reason. To cancel, email us at hello@peritale.online within that period.

Peritale is digital content and an online service. If you ask us to begin providing it during the 14-day cooling-off period, you acknowledge that you may lose your right to cancel once the service has been fully performed, or you may be charged for the part of the service already provided up to the point you cancel. In practice our 30-day money-back guarantee below is more generous than the statutory minimum, and nothing in these terms removes your statutory cancellation rights.

9. Cancellation and 30-day money-back guarantee

On top of your statutory cooling-off right, every paid plan comes with a 30-day money-back guarantee. If you are not satisfied within 30 days of your purchase, email us at hello@peritale.online and we will give you a full refund. After 30 days, refund requests are considered on a case-by-case basis. You can cancel an ongoing subscription at any time from your account or by contacting us, and cancellation takes effect at the end of the current billing period.

10. Intellectual property

All content, technology, algorithms, designs, and branding connected with Peritale are the intellectual property of MARKABLE Ltd. and are protected by applicable copyright, trademark, and patent laws. Patent pending.

• You may not copy, modify, or reverse-engineer any part of the Service.
• You may not use our trademarks without written permission.
• Your own wellness data and results belong to you.

11. Prohibited uses

You agree not to:

• use the Service for any unlawful purpose;
• submit false information, or images of other people without their consent;
• attempt to gain unauthorised access to our systems;
• scrape, crawl, or otherwise extract data from the Service beyond your own results;
• use the Service to build a competing product;
• misrepresent Peritale results as a medical diagnosis.

12. Limitation of liability

To the maximum extent permitted by law:

• the Service is provided "as is" and "as available", without warranties of any kind;
• we do not warrant that results will be accurate, complete, or reliable for any particular purpose;
• we are not liable for health decisions made on the basis of Peritale results;
• our total liability to you shall not exceed the amount you paid for the Service in the 12 months before the claim;
• we are not liable for indirect, incidental, special, or consequential loss.

Nothing in these terms limits or excludes our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded under UK law. These limits do not affect your statutory rights as a consumer.

13. Termination

We may suspend or end your access to the Service if you breach these terms. You may close your account at any time by contacting us. On termination, your right to use the Service ends, and we will delete your data on request, except where we must keep it by law.

14. Changes to these terms

We may update these terms from time to time. We will tell users about material changes through the website. Continuing to use the Service after a change means you accept the updated terms.

15. Governing law and your consumer rights

These terms are governed by the laws of the State of Israel. However, if you are a consumer in the United Kingdom, nothing in these terms affects your statutory rights, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. As a UK consumer you keep the right to bring proceedings in the courts of the part of the UK in which you live, and to use alternative dispute resolution services.
